According to the court documents, the infant plaintiff's mother reported to the defendant hospital at approximately 9:15 p.m. one evening because she was in labor. The mother was seen by one of the defendant doctors who was a resident at the time. Meconium staining was noted three hours later, and this staining is a sign of fetal distress. The presence of thick meconium was noted approximately 30 minutes later.

The court documents went on to allege that between the times of 12:10 a.m. and 2:45 a.m., the fetal heart rate was not recorded. The infant plaintiff was ultimately delivered at approximately 4 a.m. The court documents alleged that the infant plaintiff was delivered with forceps, and the documents additionally alleged that a resident was not allowed to perform this procedure in the defendant hospital.

The documents ultimately argued that as a result of this negligence, the infant plaintiff suffered severe brain damage that will require ongoing care by the infant's parents throughout his life. The documents further alleged that the defendant doctors and medical facility departed from normal and reasonable medical practices and that these departures led to this permanent injury.
