3 Landowners Petition Supreme Court For Permission To Appeal Alberta's Court Decision On MATL

TORONTO, ONTARIO--(Marketwire - Aug. 6, 2009) - Tonbridge Power Inc. (TSX VENTURE:TBZ) ("the Company") announced today that three landowners along the planned route of the MATL line have filed a request with the Supreme Court of Canada, ("SCC"), requesting permission to appeal the Court of Appeal of Alberta's decision to uphold MATL's Alberta Energy and Utilities Board, (AEUB) Permit. The AEUB permit was granted August 12, 2008. Fourteen Landowners appealed the AEUB's decision to the Court of Appeal of Alberta which ruled against them on May 5, 2009. Three of the original fourteen landowners are now asking the SCC to overturn that Court of Appeal of Alberta's decision.

The basis of the arguments in the application is the same as that rejected by the National Energy Board, the Alberta Energy Utilities Board and the Court of Appeal. Accordingly, it is the Company's view upon legal advice that this request is without merit and believes the SCC will decline to hear the appeal. This view is supported by the Company's external counsel who have advised us that appeals to the SCC must meet a rigorous National and Public interest test which does not appear to be supported by evidence in this case. The appeal of an Alberta court decision regarding an Alberta regulatory matter is unlikely to meet that test as it cannot have application beyond Alberta. The National Energy Board permit was not appealed by the landowners and is beyond appeal at this point.

The Company will proceed with its financing and construction plans and expects no delays or cost increases as a result of this latest action. The Company's permits, right to design, construct and operate an international power line remains uninterrupted.
