98.5% of Impark Customers Unaffected by Court Ruling on City Bylaw

TORONTO, ONTARIO--(CCNMatthews - May 25, 2006) - In a matter between Impark and the City of Toronto, Ontario Superior Court has ruled on "An Application Under Section 273(1) of the Municipal Act, 2001 and Under Rule 14.05(3)(D), (G) and (H) of the Rules of Civil Procedure".

This ruling concerns a City Bylaw that changed which entity would receive revenue collected from enforcement of payment for parking on those honour-pay parking lots managed by Impark and the validity of Impark's Notice of Violation.

The Court has ruled that Impark is not covered by the Bylaw and in a related decision, has ruled that the Bylaw is invalid and is quashed.

"The court has agreed with our position, so we will continue to operate as we have done in the past 98.5% of our customers are unaffected as they will continue to pay for the service in advance or when they use it," said Gordon Craig, Vice President, Eastern Canada for Impark.

"A small number who choose to pay later, at a higher cost, will receive our Notice asking for payment. It's a blue piece of paper that has a distinctly different look as compared to the City ticket. If they do not respond they will receive a letter asking for payment. Most pay when asked, because this is a preferable alternative to towing," said Craig.

Customers pay for parking at Impark lots through pay-and-display meters, attendants, pay stations, monthly parking, and by cell phone.
