First To File Is the First Patent Document Management Service to Successfully Complete SAS 70 Type II Audit

Stringent Controls for Data Protection, Security, and Confidentiality Certified by Independent Third-Party Auditor

SAN MATEO, CA--(Marketwire - December 17, 2009) - First To File® (FTF), the world's leading patent document management company, today announced that it has successfully completed a Statement on Auditing Standards No. 70 (SAS 70) Type II audit. The company is the first patent prosecution support service to earn the certification. SAS 70 is an internationally recognized auditing standard developed by the American Institute of Certified Public Accountants. A SAS 70 audit is performed by an independent auditing firm and examines the controls and processes involved in storing, handling, and transmitting data securely. The successful completion of the voluntary audit illustrates First To File's ongoing commitment to create and maintain the most stringent controls for the protection and security of its customers' confidential information. More information about FTF and its software-as-a-service (SaaS) Electronic File Room (EFR) offering is available at www.firsttofile.com.

The rigorous Type II audit, which included months of detailed testing of First To File's controls, was performed by Accell, P.A., a PCAOB-licensed firm that specializes in conducting SAS 70 audits. The auditor examined First To File's controls related to network connectivity, firewall configuration, computer operations, database access, data transmissions, backup, disaster recovery, fire suppression, physical security, and more. Following the audit, Accell issued a Service Auditors' Report with an unqualified opinion, demonstrating that First To File's policies, procedures, and infrastructure for data protection, security, and confidentiality met or exceeded the stringent SAS 70 criteria.

"Protection and security of the confidential information associated with a company's patent prosecution effort is critically important," said James Bergeron, chief executive officer, First To File. "The successful completion of our SAS 70 Type II audit provides our customers with the assurance that the controls and safeguards we employ to protect and secure their data are first-rate."

SAS 70 audits have become increasingly important for data-handling service providers since the passage of the Sarbanes-Oxley legislation, which requires a company's business partners to have adequate internal controls. First To File customers can easily incorporate its Service Auditors' Report in their Sarbanes-Oxley compliance programs as proof that appropriate controls are in place. The SAS 70 audit can also help First To File customers to comply with other regulations, including HIPAA (Health Insurance Portability and Accountability Act), GLBA (Gramm-Leach-Bliley Act of 1999), and ISO 27001.
