Law Society Tribunal Orders and Dispositions

The Law Society of Upper Canada regulates the lawyers and paralegals of Ontario in the public interest. The Law Society ensures that all lawyers and licensed paralegals in Ontario meet standards of learning, professional competence and professional conduct that are appropriate for the legal services provided.

As part of this mandate, the Law Society's Hearing and Appeal Panels recently heard the following matters. Hearing and Appeal Panels are responsible for determining the appropriate disposition of cases.

Paul John Anderson (1991), of the City of Toronto

Decision: The Appeal Panel's order dated August 14, 2009 staying the Decision and Order of August 4, 2009 is varied so as to provide that the stay extends until 10 days following the release of the Appeal Panel's reasons.

Rupen Balaram-Sivaram (2008), of the City of Toronto

Decision: The Paralegal is suspended for two months, starting immediately and continuing indefinitely until the Paralegal complies with the specified terms.

Joyce Theresa Choi-Pik Chan (1989), of the City of Toronto

Decision: The Lawyer's request for costs is dismissed.

Daniel Frank Daly (1987), of the City of Toronto

Decision: The Lawyer is suspended for one month starting January 1, 2010.

Paul Vincent Di Paolo (1979), of the City of Niagara Falls

Decision: The Lawyer is suspended for three months to run concurrently with any existing suspension and to be followed by indefinite suspension until specified terms are met. On his return to practice, he shall be subject to a two-year period of supervision on specified terms.

Alec John Dobson (1981), of the Village of Dorchester

Decision: The Lawyer's licence is revoked effective immediately.

Peter Dymoke Eberlie (1975), of the City of London

Decision: The Lawyer is suspended for one month starting December 18, 2009.

John Dennis Flood (1987), of the City of Kenora

Decision: The Notice of Application was withdrawn.

Rita Anne Hartmann (1975), of the City Toronto

Decision: The Motion is allowed. The finding of professional misconduct is set aside and a new hearing is ordered.

Jonathan Howard Marler (1975), of the Town of Oakville

Decision: The Lawyer is suspended for three months, starting on a date to be agreed upon by counsel.

David Moffat Matheson, of the Town of Markham

Decision: The Paralegal Applicant's application for a Class P1 licence is dismissed.

James Alexander Menzies (1957), of the City of Toronto

Decision: The Lawyer is reprimanded.

Reid David Rusonik (1989), of the City of Toronto

Decision: The Lawyer is suspended for one week starting December 23, 2009 through to and including December 29, 2009.

Christian Simon Michael Secker (1990), of the City of Mississauga

Decision: The Licensee is reprimanded.

Sudeesh Shivarattan (1991), of the City of Toronto

Decision: The Lawyer is suspended on an interim interlocutory basis starting immediately, and shall comply fully with specified terms, including authorizing the Law Society to cancel the Lawyer's Teranet account and access while suspended.

Andrew Bishop Tulk (1970), of the City of Mississauga

Decision: The Lawyer is reprimanded.
