Nichols Kaster, PLLP Brings Suit for Loan Officers Cheated Out of Overtime Pay by Guardian First Funding Group

NEW YORK, NY--(Marketwire - March 29, 2010) -  Nichols Kaster, PLLP filed a putative nationwide class action lawsuit on behalf of loan officers that worked for Guardian First Funding Group, LLC. The lawsuit was filed in the United States District Court for the Southern District of New York. In their complaint, the employees assert that Guardian First Funding Group, LLC violated the federal Fair Labor Standards Act and New York Labor Laws by misclassifying its loan officers as exempt from overtime pay and minimum wages. 

Plaintiffs' attorney Michele R. Fisher explained, "The case law has made clear over the past 10 years that loan officers should receive overtime pay, this company apparently thought it could cheat its loan officers without getting caught."

Plaintiffs are represented by Paul J. Lukas, Michele R. Fisher, and Reena I. Desai from Nichols Kaster, PLLP in Minneapolis, Minnesota. The case is entitled Rafael Febus et al. v. Guardian First Funding Group, LLC, and Jason Levy, and Mark Fidel individually, Case No. 1:10-cv-02590-SHS S.D. New York.
