If anyone has any information regarding actions taken by any party that might be construed as negatively affecting such leases or the equipment thereon, such person is obligated to contact the Court-appointed Receiver in this matter at 574-233-7860. The Orders of September 17, 2003 (Freeze and Turnover Order), June 26, 2006 (Injunction and Stay), September 5, 2006, and September 13, 2006, further require the continued freeze of the oil and gas lease assets and the injunction of any activity that may negatively affect said leases and/or the Receiver's custody of said leases. The following claims process constitutes the sole and exclusive procedure for addressing claims against title to said oil and gas leases: 1. Notice of any claim brought by any person or party shall be immediately made to the Receiver. Such claim shall be made in good faith, or otherwise subject to costs, fees and sanctions. 2. A period of 45 days from the date of the Opinion and Order of September 5, 2006 is provided, within which period a claimant, having been unable to reach a resolution with the Receiver and having made a good faith attempt to resolve such claim, must file such claim with this Court. 3. A subsequent period of 30 days is provided within which the Receiver must issue his response filed pursuant to subparagraph 2 above from the date of the Receiver's receipt of such filed claim, provided there is no outstanding discovery or document request, or pending motion related to discovery, which shall toll the issuance of the Receiver's response to such claim. 4. The full cooperation in a timely manner by any party having received a demand by the Receiver for information, including, but not limited to, a request for production of documents, a request for compliance with the Court's September 17, 2003 Freeze Order, or a subpoena is required. Any party failing to provide such timely full cooperation shall not be entitled to have its claim against said oil and gas leases heard by the Court and, upon notice of such failure of cooperation to the Court by the Receiver, such claim shall be subject to summary dismissal by the Court. 5. The Receiver has the right to request an extension of time for the issuance of a response to any claim filed pursuant hereto, once there has been compliance by the claimant with the discovery and document requests by the Receiver. 6. Any such claim which the Receiver and the claimant have been unable to resolve within 30 days after the issuance of the response to such claim by the Receiver shall be docketed for hearing by the Court. 7. In the event of the failure of any person, firm, corporation, limited liability company, entity or other person to file such claim in the manner provided herein, any claim of title to or interest in said oil and gas leases and lease assets shall be deemed waived and forfeited. 8. Upon the resolution of all claims submitted to the Court against said oil and gas leases, legal and equitable title to said oil and gas leases shall be vested in the Receiver. Upon said vesting, the Receiver may dispose of said oil and gas leases in any reasonable manner, subject to the approval of this Court.
