Arizona's "New" DUI Law's Automatic? Not So Fast...


SCOTTSDALE, AZ--(Marketwire - Aug 2, 2012) - Although many of Arizona's "New" DUI Laws have been around for months, some charged with Driving Under the Influence are still not receiving the benefits. Douglas Schwab, a Phoenix DUI attorney, also practicing in the Scottsdale Metro area, notes that the new laws impact everything from jail time to how many months a person is required to have an interlock device in his or her car.

Arizona's law changes can reduce the interlock requirement from 12 months to 6 months in some cases. The minimum mandatory jail requirements have also been modified and even significantly reduced in certain instances. "Allegations of criminal conduct can be life altering. The government has the burden of proving an allegation, beyond a reasonable doubt, but also of making sure that the law is applied accurately, even when it benefits the accused," Schwab says.
