BC Human Rights Tribunal Finds in Favour of Just Ladies Fitness and Women's-Only Facilities

VANCOUVER, BRITISH COLUMBIA--(CCNMatthews - Nov. 21, 2006) - The BC Human Rights Tribunal has found in favour of Just Ladies Fitness in a landmark case following a legal challenge by a male who attempted to join the women's only fitness facility. The Complainant alleged that Just Ladies Fitness Centre discriminated against him and denied him membership because he is male. Today's decision dismissed the complaint in its entirety.

"We are very pleased that the Tribunal has recognized the rights of our members to continue to exercise in a women's only environment," says Chuck Lawson, President of Just Ladies Fitness. "We will continue to provide quality programs and services customized for women who choose to exercise at Just Ladies Fitness."

The Tribunal heard the case during the week of September 12, 2005 and the decision was released today.

The decision by Tribunal Member Judy Parrack, found that:

1) The Complainant failed to present any case of discrimination based on the facts and the law.

2) The Complainant pursued this complaint for reasons unrelated to his human rights.

3) If the Complainant was allowed membership, the resulting hardship would be that all women would be denied the ability to work-out in an all-female public location.

4) The hardship to those women seeking a women-only facility would be significant; given the impact of a decision that would open Just Ladies Fitness to men, there would likely be no women-only facilities available to them.

This decision is significant as it is the first case in Canada to rule that women's right to privacy and the exclusion of men in a public fitness facility does not equate to gender discrimination against men.

The Tribunal recognized some of the reasons that some women feel uncomfortable or unsafe in a co-ed environment: religion or culture, personal history of mental or physical abuse or feeling self-conscious about their body types.
