About the Lawsuit

Biolase and certain of its executives are charged with issuing a series of materially false and misleading statements during the Class Period, violating federal securities laws.

These false statements and omissions included, in part, that: (i) there is little evidence that dental lasers (instead of drills) provides long-term benefits to teeth, only 5% of dental offices use dental lasers, and dentists were hesitant to adopt Biolase's high-cost dental lasers; (ii) Biolase's efforts to switch to a direct sales model in the U.S. were failing; (iii) Biolase's high debt burden and the onerous terms of certain of its Comerica lines of credit were financially handicapping the Company; and (iv) Biolase was not generating cash from operations and was in default of its Comerica lines of credit.
