("Align Technology" or the "Company") (NASDAQ: ALGN) during the period between January 30, 2007 and October 24, 2007, inclusive (the "Class Period").

The complaint accuses the defendants of violations of the Securities Exchange Act of 1934 by virtue of the Company's failure to disclose during the Class Period that the Company had shifted the focus of its sales force to clearing backlog, causing a significant decrease in the number of new case starts, thus rendering the Company's class period statements concerning the Company's business, operations and financial prospects materially false and misleading. According to the complaint, after the Company revealed, on October 24, 2007, that in an effort to clear prior backlog the Company had failed to focus enough effort on filling the pipeline for new case starts and that the Company had to refocus its field and channel marketing teams to generate new case growth, the value of Align's stock declined significantly.
