Cable Installers Represented by Nichols Kaster, PLLP File Lawsuit for Unpaid Overtime Wages

ATLANTA, GA--(Marketwire - March 17, 2010) -  On March 12, 2010, Nichols Kaster, PLLP filed a putative nationwide collective action lawsuit for unpaid overtime wages on behalf of cable installers and technicians that worked for telecommunications company Communications Unlimited, Inc. The lawsuit was filed in the United States District Court for the Northern District of Georgia. In their complaint, the employees assert that Communications Unlimited unlawfully denied them overtime pay for all hours they worked over forty in a week and, in some cases, misclassified them as independent contractors.

Plaintiffs' attorney Tim C. Selander explained, "Paying an employee on a 'piece rate' basis is acceptable, but employers are still obligated to pay employees overtime compensation when they work more than forty hours in a week. Our clients routinely worked overtime hours and were not properly compensated."

Plaintiffs are represented by Paul J. Lukas, Michele R. Fisher, and Tim C. Selander from Nichols Kaster, PLLP in Minneapolis, Minnesota, and John T. Sparks from Austin & Sparks, P.C. in Atlanta, Georgia. The case is entitled Hobson et al. v. Communications Unlimited, Inc. and C.U. Employment, Inc., Case No. 1:10-cv-0734, N.D. Georgia.
