Canada Revenue Agency: Beamsville Trucker Sentenced to House Arrest for Not Filing Tax Returns

ST. CATHARINES, ONTARIO--(Marketwire - April 18, 2008) - William Sturk, of Beamsville, was found guilty on April 16, 2008, in the Ontario Court of Justice in St. Catharines, on five counts of failing to file personal income tax returns and three counts of failing to file GST returns. He was sentenced to 60 days house arrest and fined $1,000 per count for a total fine of $8,000. This fine is in addition to the taxes and interest owed, as well as any civil penalties that may be assessed by the Canada Revenue Agency (CRA).

Mr. Sturk failed to file his personal income tax returns for 2001 to 2005. He also failed to file GST returns for 2004 through to 2006. The CRA made several requests for these returns before serving Mr. Sturk with notices demanding that the returns be filed. His failure to comply with these notices resulted in charges being laid.

This is the second time Mr. Sturk has been convicted for failing to file his tax returns. On June 9, 2006, he was fined $4,000 after he was found guilty of not filing his 2001 to 2004 personal tax returns.

When individuals or corporations are convicted of failing to file tax returns, in addition to any fines imposed by the courts, they are still obligated to file the tax return and pay the full amount of taxes owing, plus interest, as well as any civil penalties that may be assessed by the CRA.

Anyone who does not file a personal or corporate income tax return or a GST return as required, or who does not comply with a court order to file is guilty of an offence. On summary conviction, a person or corporation is subject to a fine of $1,000 to $25,000 and imprisonment for up to twelve months for each count.
