Court Rules in Favor of Ivera Medical in False Advertising Lawsuit, Denies Catheter Connections Motion


SAN DIEGO, CA--(Marketwired - Feb 26, 2014) - Ivera Medical Corporation, headquartered in San Diego, CA, announced that the U.S. District Court for the Southern District of California ruled in its favor and against Catheter Connections in its false advertising and unfair competition lawsuit. The suit was filed under the Federal Lanham Act, 15 U.S.C. §1125(a), et al. and California Bus. & Prof. Code §17200, et seq., Case No. 3:13-cv-2452W RBB.

The Ivera suit claims that Catheter Connections falsely represented to the United States government that its DualCap Solo product was made in the United States, when in fact it was made in China. Catheter Connections moved to dismiss the claim, but the Court denied the motion, stating in part that "[t]he act of describing its product as made in the United States may have been false or at least misleading."

The suit further states that Ivera has been damaged due to these acts of false advertising and unfair competition and will continue to suffer irreparable injury unless Catheter Connections' activities are enjoined.
