COURT UPHOLDS UNION'S RIGHT TO FREEDOM OF COMMUNICATION WITH MEMBERS

Court dismisses Teamsters Local 987, Pat Pope and Ed Bodnaryk award of $12,500 Attention: Business/Financial Editor, City Editor, News Editor, Government/Political Affairs Editor CALGARY, ALBERTA--(CCNMatthews - Aug. 22, 2005) - The Alberta Court of Appeal has found that Douglas O'Halloran, President of UFCW Canada Local 401 was simply acting "with a sense of duty in a bona fide desire to protect the legitimate interest of their union" in the matter of negotiations with MacDonalds Consolidated Ltd. for Edmonton and Calgary locations.

Mr. Justice Ronald Berger of the Court of Appeal concluded that, "the limits of duty and interests were not exceeded," he said.

"I would allow the appeal having concluded that the evidence at trial was insufficient to defeat the defence of qualified privilege. The damage award totaling $12,500 is set aside."

Mr. O'Halloran was relieved to find that the judges agreed that, as President of Local 401, he had a duty to communicate the state of negotiations with the concerned membership. President O'Halloran said, "It is unfortunate that union dues of UFCW Local 401 and Teamsters Local 987 were wasted in court when the money could have been better spent fighting employers who continue to attack the living standards, wages and benefits of hard working union members."
