Chaya Hendrick said SmartMetric is encouraged by the Courts ruling in keeping the trial date of September 2013. The trial by Jury in September she said is the culmination of a number of years of legal presentations before the Court which included a successful appeal to the United States Federal Appeals Court in Washington, D.C. She said that SmartMetric is welcoming the trial by Jury that it requested, noting that when the 12 good Citizens of California are presented with the facts of our case up against the legal might of Visa and MasterCard that justice will prevail.

SmartMetric, Inc. is suing for yet to be specified damages and other payments, both Visa and MasterCard in the Federal District Court of California for Patent Infringement of SmartMetric's "464" issued patent.
