Drivers Represented by Nichols Kaster & Anderson Bring Nationwide Fair Labor Standards Act Lawsuit Against Renzenberger, Inc. for Overtime Pay

KANSAS CITY, KS--(Marketwire - February 22, 2008) - Nichols Kaster & Anderson, PLLP has brought a putative nationwide collective action against Renzenberger, Inc., a company that provides transportation services to the railway industry. The suit was filed in the United States District Court for the District of Kansas on February 8, 2008 by two current employees who work at Renzenberger's Kansas location. These individuals assert that they were misclassified as exempt employees and are entitled to overtime pay under the federal Fair Labor Standards Act. They seek to pursue this pay on behalf of themselves and other Renzenberger road drivers.

Renzenberger's road drivers transport train crews to and from destinations along the railways. Plaintiffs' attorney Charles Frohman stated, "Renzenberger, which operates in more than twenty states around the country, uniformly classified its road drivers as exempt from the FLSA's overtime requirements, even though it appears that many of its drivers should have been paid for their overtime hours worked."

Earlier this month, Coach America Holdings, Inc., a national charter bus operator that operates Gray Line, signed a letter of intent to acquire 100% of the capital stock of Renzenberger, Inc.

Plaintiffs are represented by Charles Frohman, Paul Lukas, and Donald Nichols from Nichols Kaster & Anderson, PLLP, which has offices in Minneapolis, Minnesota and San Francisco, California. The case is entitled Gary Tews, et al. v. Renzenberger, Inc., Civ. No. 08-cv-2064 JWL/JPO, D. Kansas.
