Florida Homestead Law Group Supports State Foreclosure Mediation Guidelines

Managed Mediation Is the Best Solution for Homeowners

FORT LAUDERDALE, FL--(Marketwire - January 26, 2011) - Florida Homestead Law Group, a law firm focused on providing interdisciplinary services to clients facing residential mortgage loan issues, advises homeowners considering participation in Florida's mediation program to first consult a licensed attorney.

In December, the Florida Supreme Court mandated a mediation program for all Florida homeowners facing foreclosure. This program provides eligible homeowners access to housing counselors, court-trained mediators and Florida Loan Mediation Attorneys as they work with their lenders to achieve a mutually agreeable resolution to a mortgage foreclosure.

"One of the reasons why the managed mediation program in Florida should be more successful at helping homeowners stay in their homes and obtain a loan modification is that the homeowner, the lender and their respective attorneys must meet face-to-face to efficiently and thoroughly review the borrower's financial state of affairs," said Scott Podvin, Lead Attorney for Florida Homestead Law Group.

With Florida being one of the hardest hit states in the nation, with approximately 500,000 property foreclosures pending according to the Florida State Courts Administration, homeowners need to be aware about what the mediation program entails and the rights borrowers are entitled to throughout the mediation process.

"Before a Florida homeowner agrees to participate in the mediation program, enter into a temporary or permanent loan modification agreement, sell their property short or enter into a deed in lieu of foreclosure transaction, they should first consult an attorney or law firm that has experience in foreclosure law and mortgage modifications," Podvin said.

Mediation enables troubled homeowners to meet with their lenders without fear, and also brings both parties together in an informal setting to renegotiate mortgage loan terms.
