German Company From the Spectrum Brands Group Is Accepting Marketing Stop for Specific Algaecides


HOF, GERMANY--(Marketwired - Apr 30, 2013) - Tetra GmbH has recognised the full scope of the civil action launched by its German competitor Söll GmbH before the Hamburg Regional Court on April 10, 2013. Tetra GmbH has its headquarters in Melle, Germany and has been a part of the American group Spectrum Brands Inc. since 2005 that is listed on the stock exchange. That is the content of a corporate report from Söll GmbH on this legal action. Its subject matter was marketing the algaecide Tetra Pond Algo Rem for ponds that contains the non-permitted active ingredients of aluminium hydroxide chloride. Söll GmbH submitted that civil action against marketing algaecides with the active ingredients of aluminium hydroxide chloride to the Hamburg Regional Court at the end of 2008. 

The Hamburg Regional Court submitted questions for interpreting the applicable biocide guideline to the court of Justice of the European Union and it smoothed the way to the judgement by confession that was rendered. Tetra GmbH is now obliged to omission, compensation for damage and disclosure to Söll GmbH. After Tetra GmbH rejected a proposal for an arrangement for settling disclosure and the claims to compensation for damage, Söll GmbH is intending to lodge action by stages against Tetra GmbH for disclosure and compensation for damage at the Hamburg Regional Court. The amount of the demands is scaled according to the scope of marketing the algaecides with non-permitted active ingredients and the damage that Söll GmbH has incurred and will incur from marketing in future.

Incidentally, Söll GmbH was able to discover that the successor product Tetra Pond Crystal Water that is currently being marketed in Europe also contains the active ingredients of aluminium hydroxide chloride. That means that marketing this product will also be taken into account when calculating the compensation for damage.
