Inside Sales Consultants, Led by Nichols Kaster, PLLP, Bring Suit Alleging They Were Improperly Denied Overtime by Author Solutions, Inc.

INDIANAPOLIS, IN--(Marketwire - March 8, 2010) - On March 4, 2010, three inside sales consultants brought a collective action against Author Solutions, Inc., and its subsidiaries, AuthorHouse, Inc., iUniverse, Inc., Xlibris, Corp. Trafford Publishing, Inc., and Wordclay, Inc., in the Southern District Court of Indiana, alleging that Defendants denied them of overtime compensation under the Fair Labor Standards Act (FLSA). 

According to the Complaint, Author Solutions, Inc. hires inside sales consultants, such as publishing consultants, marketing consultants, editorial consultants, book consultants, channel book sales, and those working under similar titles, to solicit authors and sell self-publishing packages. Author Solutions, Inc. compensates these employees on a salary and commissions basis, but does not provide them with overtime premiums for hours worked over forty in a work week. The Complaint also argues that these persons do not qualify under any of the FLSA exemptions, and thus are entitled to their unpaid overtime.

The case is entitled Slavik, et al. v. Author Solutions, Inc., et al.., No. 1:10-cv-00257-LJM-TAB (S.D. Ind.) (filed Mar. 4, 2010). Plaintiffs are represented by Michele R. Fisher, Paul J.
