JCM Global's Jury Verdict Affirmed by Federal Circuit Court of Appeals

Ruling Effectively Brings JCM's Assertion of Its Patents to Successful Close

LAS VEGAS, NV--(Marketwire - November 10, 2010) -  The U.S. Court of Appeals for the Federal Circuit has affirmed a 2009 U.S. District Court jury verdict, whereby JCM Global was awarded more than $11.4 million in damages caused by the infringement of its removable pusher patent by MEI.

Late last year, a U.S. District Court judge upheld a Las Vegas jury's January 2009 verdict that validated the JCM's infringement claim which surrounded JCM's innovative, removable stacker mechanism, detailed in U.S. Patent No. 5,372,361, that the jury found MEI's CASHFLOW products infringed on four separate claims. In his ruling, the judge awarded JCM approximately $845,000 in interest on the $11.4 million jury award, issued a permanent injunction against MEI, denied all post-trial motions filed by MEI and required a bond in the amount of approximately $12,475,000.

The expected release of the bond to JCM will effectively bring this case to a close. The court-issued permanent injunction against sales of MEI products that deploy the design found to infringe in the Nevada litigation remains in effect, enjoining MEI from "making, using, selling or offering to sell, or importing into the United States, the Cashflow SC Series products with a removable pusher that were found by the jury to infringe upon the '361 Patent."

JCM Global President/CEO Akiyoshi Isoi said, "We are extremely pleased that the appellate court affirmed the jury verdict against MEI. We aggressively defended our patents and plan to do so again in the future, should the need arise."
