Jeffer, Mangels, Butler & Marmaro Leverages Attenex to Quickly Find Key Documents Among Nearly 50 Million Pages of Records

Resulting in a More Than $500 Million Award, JMBM's Selection of Attenex Patterns Leads to One of the Largest Patent Awards of the Year

SEATTLE, WA -- (MARKET WIRE) -- August 9, 2005 -- Attenex® Corp., a leading software developer of document analysis and visualization tools for electronic discovery, today announced that Jeffer, Mangels, Butler & Marmaro (JMBM), one of the most innovative law firms in the Western United States, selected Attenex to expedite the review of nearly 50 million pages of documents. Attenex software served a crucial role, helping JMBM quickly find incriminating evidence, including a spreadsheet that revealed the strategic intent behind Medtronic's dealings with JMBM's client and became a focal point of the trial.

The Medtronic vs. Michelson suit involved more than 20 different claims, and JMBM, representing Dr. Gary Michelson, required an effective and efficient way to search and manage millions of documents in just four months. JMBM turned to an industry leader in electronic discovery and litigation support services, Forensics Consulting Solutions, Inc., and on their recommendation, selected Attenex Patterns® to quickly and effectively locate only the most relevant documents. "Attenex Patterns demonstrated immediate benefits within only a few weeks by significantly reducing the amount of reviewable material and isolating the key documents," said Dan Sedor, partner, JMBM.

"Forensics Consulting Solutions' guidance in selecting an effective electronic discovery solution, combined with their hands-on approach in working with us and Attenex every step of the way, was extremely helpful," continued Sedor. "Attenex Patterns enabled us to quickly gain a visual understanding of the entire review corpus, displaying how the documents relate to each other, as well as offering the ability to both find and browse the same documents using a key concept. Using Attenex Patterns, we uncovered electronic evidence in time to use it in numerous depositions, summary judgment motions, trial preparation and trial."

In preparation for the discovery process, JMBM assembled a team of associates, summer associates and paraprofessionals. In a dedicated electronic review conference room, the team used seven workstations networked on a secure server loaded with Attenex Patterns to review data in 1,000 document batches from 9 a.m. - 8 p.m., six days a week. Taking less than four months, the team successfully sifted through almost 50 million pages of electronic records, locating essential documents, like the key spreadsheet, that led to a huge verdict for Dr. Michelson.

"Attenex Patterns is a great solution for complex and high-stakes litigation involving large amounts of electronic discovery because it enables legal professionals to rapidly and efficiently review, analyze and organize responsive electronic materials," closed Sedor. "The costs of the electronic review, including attorney review time and hardware and software costs, were significantly less than using a more traditional approach, and yielded very important evidence in the case, ultimately resulting in a tremendous half-billion dollar verdict for our client. We have not seen any other product that offers such unique features."
