Judge dismisses OPG injunction application

Attention: Assignment Editor, Business/Financial Editor, Energy Editor, News Editor, Tech/Telecomm Editor TORONTO, ONTARIO--(CCNMatthews - June 23, 2005) - An Ontario judge has dismissed an application by Ontario Power Generation to limit picketing by striking Hydro One employees.

"We're glad Mr. Justice McLean left intact our constitutional right to picket," said Keith Rattai, Vice President of the Hydro One Local of the Society of Energy Professionals. "Our picketers were peaceful and polite, our actions were supported by a very large majority of the Power Workers Union- and Society-represented employees we were communicating with, and OPG had no good reason to attempt to limit us."

While an OPG representative conceded that their "strike contingency plan" hadn't been successful, Mr. Justice McLean ruled that OPG had not demonstrated that Society picketing was causing "irreparable harm," the test that must be met before the Courts are allowed to interfere with the picketing rights of people on strike.

The Society had set up picket lines at OPG's Darlington Nuclear Generating Station in the early hours this morning, causing long lines of vehicles to line up while picketers communicated with employees on their way to work. The picketers were energy professionals employed by Hydro One, who have been on strike since June 1st.

The Society of Energy Professionals represents more than 6,000 professional employees in the electricity industry in Ontario, including engineers, scientists, supervisors, and others. The Society is Local 160 of the International Federation of Professional and Technical Engineers.
