Judge Grants Conditional Certification in Wisconsin Bell Overtime Lawsuit Brought by Nichols Kaster, PLLP on Behalf of Outside Plant Engineers

MADISON, WI--(Marketwire - February 4, 2010) - On February 2, 2010 Judge Barbara B. Crabb of the United States District Court for the Western District of Wisconsin conditionally certified a class of Outside Plant Engineers that worked for Wisconsin Bell between February 2, 2007 and May 16, 2009. The Court further ordered the plaintiffs to mail judicial notice to all Outside Plant Engineers that have not yet joined the lawsuit.

The lawsuit alleges that Outside Plant Engineers who worked for Wisconsin Bell were misclassified as exempt employees up through May 16, 2009, when the company reclassified them to non-exempt employees. As a result of the misclassification, Wisconsin Bell did not pay its Outside Plant Engineers overtime wages when they worked more than 40 hours in a workweek. Outside Plant Engineers employed by Michigan Bell and Illinois Bell have also filed lawsuits alleging similar facts.

The Wisconsin case is entitled Wittemann, et al. v. Wisconsin Bell, Inc., No. 09-cv-440 (W.D. Wis.). The Michigan case is entitled Wlotkowski, et al. v. Michigan Bell Telephone Co., No. 2:09-cv-11898 (E.D. Mich.). The Illinois case is entitled Smallwood v. Illinois Bell Telephone Co., No. 1:09-cv-4072 (N.D. Ill.).
