Julia Strickland Named as Top Woman Litigator

Ms. Strickland's practice focuses on the defense of class actions and other complex commercial actions brought against a multitude of companies. She possesses expertise for the full range of litigation issues confronting large corporations, ranging from responding to regulatory investigations to handling all aspects of active litigation. She has defended hundreds of class and complex actions and has argued twice to the California Supreme Court as lead counsel on issues of critical concern in connection with the defense of class actions. She also has successfully handled matters before the Ninth Circuit, Fifth Circuit, Second Circuit and the California Courts of Appeal.

Ms. Strickland scored a major victory under the California Consumers Legal Remedies Act in Berry v. American Express. This landmark case held that credit card issuers may not be sued under the statute, and the decision has been interpreted broadly in other cases to hold that transactions for "money or credit" generally -- all lending activity -- are not regulated by the statute. This decision faced repeated challenges in 2007 and Ms. Strickland has been successful in upholding it in multiple cases.

Ms. Strickland obtained a major victory on summary judgment for Washington Mutual regarding charges on ATM withdrawals in March 2008. In this 4 1/2 year litigation, originally filed under the federal Truth in Lending Act, she first prevailed in the federal district court. On plaintiff's appeal, the Ninth Circuit upheld most of the judgment, but the case was remanded to the trial court for further findings on two of plaintiff's claims. After further litigation, the trial court reinstated its original judgment in favor of the bank, based upon further factual findings requested by the appellate court. This case gained significant attention at the highest levels, with the Board of Governors of the Federal Reserve System participating in the appellate briefing.

Ms. Strickland has vast experience settling all types of class and complex actions. She is versatile and creative in addressing settlement considerations, both legal and business, and the wide spectrum of settlement structure options. She successfully concluded a major nationwide settlement for American Express relating to foreign currency conversion fees. In 2007, Ms. Strickland successfully concluded a settlement of a major multi-state attorney general investigation of a national bank, to regulatory and attorney general inquiries on behalf of her clients, and often seeks to resolve matters on fair terms before formal litigation is filed.
