About the Lawsuit

KiOR and certain of its executives are charged with issuing a series of materially false and misleading statements regarding the Company's business, operations, and prospects during the Class Period, violating federal securities laws.

On August 8, 2013, KiOR disclosed that the Company's Columbus, Mississippi facility had only shipped 75,000 gallons of fuel during the second quarter of 2013, which was radically below the 300,000 to 500,000 gallons of fuel production that Company had projected just a few months before, on May 9, 2013. As a result, KiOR announced revenue of only $240,000 for the quarter, well below analysts' estimates.

On this news, KiOR shares fell drastically -- from $4.76 per share on August 7, 2013 to $2.62 on August 15, 2013.
