Law Society Regulatory Proceedings for November 2010

The Law Society of Upper Canada regulates the lawyers and paralegals of Ontario in the public interest. The Law Society ensures that all lawyers and licensed paralegals in Ontario meet standards of learning, professional competence and professional conduct that are appropriate for the legal services provided.

As part of this mandate, the Law Society's Hearing and Appeal Panels recently heard the following matters. Hearing and Appeal Panels are responsible for determining the appropriate disposition of cases. 

Jikrishin Rupchand Ambwani (1992), of the City of Toronto
Decision: The Lawyer is granted permission to surrender his licence and resign his membership in the Law Society.
 
Ormila Bhoopaul, of the City of Toronto [Paralegal Applicant]
Decision: The application for a licence is denied.
 
Richard Kazimierz Chojnacki (1989), of the City of Mississauga
Decision: The Lawyer's licence is immediately revoked.
 
Karen Rosalee Caroline Cunningham (a.k.a. Karen Rosalee Caroline Cunningham-McBean) (1996) of the City of Mississauga.
Decision: Starting January 1, 2011, the Lawyer is suspended on an interim interlocutory basis. She will comply with specified terms.
 
Andrew Michael Czernik (1980), of the City of Toronto
Decision: The Lawyer is reprimanded.
 
Moeen Mahmood Ahmad Janjua (1976), of the City of Mississauga
Decision: The Lawyer's licence is revoked. In the absence of any response to the Request to Admit by the Lawyer on or before November 30, 2010, both the finding of this Panel and the revocation Order will become effective on December 1, 2010.
 
Irene Mary Kimberley (2002), of the City of Toronto
Decision: The Lawyer is suspended for four months starting at the end of her current administrative suspension(s), and continuing indefinitely until she has met specified terms to the satisfaction of the Director of Professional Regulation of the Law Society. For a period of two years from the date of her return to practice, the Lawyer shall comply with further specified conditions.
 
Robert Nestor Kostyniuk (1968), of the City of Mississauga
Decision: The Lawyer is reprimanded.
 
Oleg Oleksandro Kryvenko (2008), of Thornhill
Decision: The Paralegal's six month suspension will start on the date that the two suspensions ordered on July 16, 2010 and September 29, 2010 expire.
 
Jonathan Howard Marler (1975), of the City of Oakville
Decision: The Lawyer's appeal from the Decision and Order dated October 2, 2009 is dismissed.
 
Gaetano Pietro Matteazzi (1988), of the City of Toronto
Decision: The Lawyer is reprimanded.
 
Mariano Mazzucco (1975), of the City of Mississauga
Decision: The Lawyer's licence is immediately revoked.
 
Clarke Austin Merritt (1978), of the City of Toronto
Decision: The Lawyer is suspended for two months starting January 17, 2011. During his suspension and for a period of 12 months starting in April 2011, he shall comply with specified terms.
 
Pradeep Briglal Pachai (1988), of the City of Toronto
Decision: The Lawyer's licence is revoked.
 
Massimiliano Pecoraro (1998), of the City of Toronto
Decision: The Lawyer's licence is revoked.
 
Vincent George Sinclair, of the City of London [paralegal applicant]
Decision: The appeal is dismissed.
 
Carl Heinrich Schuetz (1998), of the City of Toronto
Decision: The Lawyer is suspended for one month, starting at the conclusion of the Lawyer's administrative suspension, and continuing indefinitely until specified conditions are met.
 
Robin Douglas Scott (1985), of the Town of Whitby
Decision: The Lawyer's licence is revoked immediately.
