Minister Raitt Refers Air Canada Concerns to the Canadian Industrial Relations Board

OTTAWA, ONTARIO--(Marketwire - March 8, 2012) - The Honourable Lisa Raitt, Canada's Labour Minister, has referred a question with respect to the application of subsection 87.4 (1) (maintenance of activities) at Air Canada to the Canadian Industrial Relations Board (CIRB).

"Our Government received a strong mandate to protect the Canadian economy and Canadian jobs, so we have been closely following the negotiations between Air Canada and the Air Canada Pilots Association, and Air Canada and the International Association of Machinists and Aerospace Workers," said Minister Raitt. "I have asked the CIRB to review the situation at Air Canada to ensure that the health and safety of the public would not be affected during a work stoppage."

Under the Canada Labour Code, the CIRB, upon referral by the Labour Minister during a labour dispute, may issue binding orders with respect to the maintenance of activities to ensure that a work stoppage does not threaten public safety or health. Both the unions and the employer must continue their normal work activities until the matters of maintenance of activities have been decided upon by the CIRB.

"I am concerned that the parties have not been able to reach agreements," said Minister Raitt. "I encourage the parties to continue working together to resolve their individual disputes and restore confidence for the traveling public and Canadian job creators that rely on commercial air services."

The CIRB is an independent, representational, quasi-judicial tribunal. Its mandate is to interpret and apply the provisions of Part I of the Canada Labour Code that deal with collective bargaining and unfair labour practices.
