NBS Technologies Inc. Receives Response from DataCard Corporation Relating to Patent Infringement Suit

TORONTO, ONTARIO--(CCNMatthews - Jan. 13, 2006) - NBS Technologies Inc. ("NBS") (TSX:NBS) announced today that it has received an Answer and Counterclaims from DataCard Corporation ("DataCard") to the suit against Datacard that NBS filed on November 1, 2005 in the United States District Court for Minnesota. The original suit against DataCard alleges infringement of certain patents owned by NBS relating to its UbiQ software suite.

DataCard's Answer denies infringement of the NBS patents. DataCard's Counterclaims are for patent infringement of three DataCard patents and for tortious interference. The tortious interference claim arises out of the same transaction that is the subject matter of a United States Department of Justice request to NBS to provide certain information regarding an NBS contract to supply card personalization equipment to a contractor in connection with a Nigerian national identification program. DataCard is claiming lost profits for the alleged tortious interference.
