Nerium Biotechnology Seeks Injunction Against Nerium International, LLC and Nerium International Hong Kong Limited

SAN ANTONIO, TEXAS--(Marketwired - Aug. 3, 2016) - Nerium Biotechnology, Inc. ("Nerium" or the "Company") reported today that it has filed an application in Hong Kong seeking an injunction against Nerium International, LLC (the "Distributor") and its subsidiary Nerium International Hong Kong Limited. As with other actions commenced by the Company in the courts of Texas and the United States federal courts, the Company is acting to protect its intellectual property against infringement by the Distributor and to prevent other actions that would constitute a breach of the Company Agreement that governs the Distributor.

The Distributor was formed to act as a distributor of certain products researched, developed, and produced by Nerium and its subsidiary Nerium SkinCare, Inc. ("Nerium SkinCare"). Through Nerium SkinCare, the Company holds a minority ownership interest in the Distributor. The majority ownership interest in the Distributor is held by JO Products, a company controlled by the Distributor's sole manager, Jeff Olson.

The Company filed its application in response to the Distributor's recent actions in Hong Kong, including its application to register trademarks containing the word "Nerium" and its attempt to invalidate the Company's trademark "NeriumAD" in Hong Kong. The Company is seeking an injunction against the Distributor and its Hong Kong subsidiary to restrain them from infringing the Company's trademarks, acting in breach of the Company Agreement and committing the tort of passing off in Hong Kong.
