New Jersey Lawyer Saves a Teaneck Family Home From Foreclosure

HACKENSACK, NJ--(Marketwire - May 2, 2011) - A New Jersey family recently received the news they had been eagerly waiting for since their foreclosure nightmare began in May 2009. Like many families in today's troubled economy, this Teaneck, NJ family experienced a loss of income and an increase in living expenses, which made it impossible for them to keep up with their mortgage payments and their other financial obligations. They were served with a Summons and Complaint in May 2009, which started the foreclosure lawsuit against them. The family felt that they had no chance of keeping their home, where they were raising their young children.

The homeowners reached out to their mortgage company, attempting to obtain a mortgage modification to keep their home, but each interaction with the mortgage company was filled with anxiety, stress and with each passing day they became less and less optimistic about getting the mortgage modification they desperately desired.

Through a local charity, they were introduced to attorney David Giller, who assessed their situation, and explained their options to save their home. Mr. Giller defended the foreclosure lawsuit, requiring the mortgage company to prove that they had legal standing to sue the homeowners in the foreclosure lawsuit brought against them in court. Simultaneously, Mr. Giller leveraged the New Jersey State Foreclosure Mediation Program in order to facilitate bringing the homeowners and their mortgage company to the table in order to work out a mortgage modification program that is both reasonable to the mortgage company and affordable to the homeowners at their reduced income level.

In April 2011, they finally obtained the mortgage modification proposal they had been anxiously pursuing, and shortly thereafter, their mortgage company voluntarily dismissed their foreclosure case from the Superior Court of New Jersey. The homeowners are currently paying a mere 2% interest on their mortgage, which is still affordable on their reduced income.

"Like so many families in Bergen County, these parents are working hard, trying to support their four children. Unfortunately, life threw them a curve ball and the cycle of debt quickly began to overwhelm them," says Mr. Giller. "They didn't intentionally skip mortgage payments. They lost their jobs, and simply didn't have the money to pay their bills. I take pride in knowing that I was able to stop the cycle of debt for this family, eliminate their credit card bills through bankruptcy and then help them obtain a mortgage modification, to keep their home. Let's face it, mortgage companies do not want to own real estate. They want to get paid the money that's owed to them. Being able to help families in need while also addressing the concerns of the mortgage companies is incredibly rewarding."
