Specifically, this lawsuit was filed on behalf of an infant who allegedly suffered multiple injuries as a result of substandard medical care provided by the defendant hospital. The case was filed and it was assigned a case number of A04015. The lawsuit was initiated because the plaintiff infant suffered from quadriplegia, severe developmental delays and a seizure disorder among other problems which are detailed below.

According to the court documents, the case arose after a mother, whose pregnancy had been largely uneventful, was told on the day before the infant was born that she should have a C-section birth because the baby was large. The documents went on to state that the next morning, the mother reported to the defendant hospital with intense labor pains.

The mother, according to court documents, was given medication and she delivered the child three hours later. The infant weighed 8 pounds and 10 ounces at birth. The documents further stated that the doctors noticed a very weak cry from the child after birth and they transferred him immediately to NICU, or the Neonatal Intensive Care Unit.

The court documents alleged that while in NICU, the baby encountered periods where he stopped breathing. The doctors at the hospital eventually determined that the baby's diaphragm was not working properly, and corrective surgery was performed in response to this diagnosis. Three months later, the baby was sent home after his condition improved.

However, the court documents went on to allege that in June, the mother received notice from the defendant hospital that the baby had been clinically dead while in NICU for a period of 55 minutes. Although he was resuscitated, the court documents stated that the baby suffered injuries that included cardiorespiratory arrest, bilateral pneumothoraces, hypoxic Ischemic encephalopathy and gastroesophageal reflux disease in addition to those mentioned above.

After the lawsuit was filed against the defendant hospital, the parties to the lawsuit were able to avoid fully litigating the matter because the parties successfully negotiated a settlement in the amount of $1,275,000.00. As a result of this successful settlement negotiation, the lawsuit has been dismissed and the parties consider this matter closed.
