The New York Medical Malpractice Lawyers at Fitzgerald & Fitzgerald, URL, Have Settled a Birth Injury Lawsuit for $1.6 Million

NEW YORK, NY--(Marketwired - Apr 25, 2013) - The New York medical malpractice lawyers at Fitzgerald & Fitzgerald have been representing clients who have been injured or worse because of substandard medical care since the firm began operations in 1971. The attorneys at the firm handle cases that involve birth injuries that were sustained because of mistakes made during the delivery process, because of negligent prenatal care and because of failures to diagnose conditions present in newborns. The firm hereby announces that it has successfully negotiated a settlement with regards to a birth injury lawsuit on behalf of an injured infant client in the amount of $1,600,000.00.

Specifically, this lawsuit was filed in the Bronx County Supreme Court against a defendant hospital and the defendant hospital's Chief Resident. The case was assigned a case number of 88346A and it was filed because the infant plaintiff allegedly suffered injuries that included Erb's palsy and damage that led to learning disabilities because of negligence on the part of the defendants named in the lawsuit.

According to the court documents, the infant plaintiff's mother reported to the hospital in anticipation of giving birth to a child. The court documents alleged that the defendant failed to recognize the warning signs of shoulder dystocia during delivery, and that the defendant doctor pulled and twisted the child's head for a period of approximately 5 minutes before he could be delivered. The documents further claimed that the defendant doctor was negligent because he manually rotated the child's head without a clear plan for managing the dystocia.

Finally, the court documents alleged that the defendant doctor should have flexed the mother's legs against her abdomen, applied suprapubic pressure, attempted the Woods maneuver and then, if the child still could not be delivered, fractured the clavicle. However, the documents stated that none of those steps were attempted.

The child was born with mild to moderate Erb's palsy of the right brachial plexus and he later developed learning difficulties requiring special education classes. Rather than litigating the matter all the way through trial, the two sides were able to come together and negotiate a settlement in the amount of $1,600,000.00. In consideration for the payment of the settlement amount, the New York medical malpractice lawyers at Fitzgerald & Fitzgerald dismissed the lawsuit with prejudice, thereby bringing a close to the matter.
