The documents further claimed that the defendant doctor was negligent because he manually rotated the child's head without a clear plan for managing the dystocia.

Finally, the court documents alleged that the defendant doctor should have flexed the mother's legs against her abdomen, applied suprapubic pressure, attempted the Woods maneuver and then, if the child still could not be delivered, fractured the clavicle. However, the documents stated that none of those steps were attempted.

The child was born with mild to moderate Erb's palsy of the right brachial plexus and he later developed learning difficulties requiring special education classes. Rather than litigating the matter all the way through trial, the two sides were able to come together and negotiate a settlement in the amount of $1,600,000.00.
