The lawsuit that was filed in response to this incident was filed in the Queens County Supreme Court against a defendant hospital that is located there. The plaintiff in the case was an infant who was injured while receiving medical care in furtherance of his birth. The case was assigned a case number of A00136 and it sought damages based on the alleged negligence of the defendant hospital.
According to the court documents, the lawsuit arose after the mother of the infant plaintiff reported to the defendant hospital at 32 weeks of gestation complaining of cramps, vaginal bleeding and abdominal pain. She was examined and she was found to be 9 centimeters dilated, and the plaintiff infant was born less than an hour later weighing just over four pounds given the premature birth.
Soon after birth, the infant was placed in an observation area and it was discovered that he was suffering from elevated bilirubin levels. He was treated with phototherapy, but the court documents at this point alleged that the defendant hospital failed to notice that the infant was feeding very slowly and that he gave a poor sucking response throughout the following two weeks. In addition, the court documents alleged that the defendant hospital failed to diagnose and prevent oxygen desaturation and decreased heart rate in the infant plaintiff and the fact that the he was anemic with only a 9.9 hemoglobin count.
The court documents went on to allege that the plaintiff infant suffered from a brain bleed and that the defendant hospital failed to diagnose any of these conditions. The New York medical malpractice lawyers at Fitzgerald & Fitzgerald ultimately alleged that due to the failure to diagnose these conditions, the plaintiff was eventually diagnosed with cerebral palsy, paralysis of the right side of his body, cognitive impairment and developmental delays. Based on these arguments presented at trial and in the court documents, the jury awarded the plaintiff damages in the amount of $1,700,000.00.
