Nichols Kaster & Anderson Brings Suit Against Breakfast Food Giant, Kellogg Company, on Behalf of Plant Workers

MEMPHIS, TN--(Marketwire - May 8, 2008) - Nichols Kaster & Anderson and the Donati Law Firm have brought a nationwide lawsuit on behalf of hourly workers who are or were employed by Kellogg Company as operators or production workers in any of its numerous plants located across the country. According to the Complaint, Kellogg Company operates manufacturing plants in Battle Creek, Michigan, Memphis and Rossville, Tennessee, Lancaster and Muncy, Pennsylvania, Omaha, Nebraska, and London, Ontario. The lawsuit was filed in the United States District Court for the Western District of Tennessee on May 5, 2008.

The employees assert that they were not paid for time spent putting on and taking off safety gear and equipment as well as time spent walking from the changing area to the time clock and from the time clock to the changing area at the beginning and end of each shift.

Plaintiffs' attorney Rachhana T. Srey stated, "Kellogg's required these employees to wear all this gear to do their job. There should be no question that they should be paid for the time they spent doing this for Kellogg's benefit."

Plaintiffs are represented by Donald Nichols, Paul J. Lukas, and Rachhana T. Srey from Nichols Kaster & Anderson, PLLP in Minneapolis, Minnesota and the Donati Law Firm in Memphis, Tennessee. The case is entitled Franklin et al v. Kellogg Company, Case No. 2:08-cv-2268, W.D. Tenn.
