Nichols Kaster, PLLP Files Claims in Arbitration for Loan Officers Denied Overtime Pay by BNC National Bank

OLATHE, KS--(Marketwire - October 20, 2010) -  On October 14, 2010, Nichols Kaster, PLLP filed demands for arbitration on behalf of 25 loan officers who worked for BNC National Bank and BNCCORP, Inc. One of the demands was filed as a putative collective action and asserts overtime and minimum wage claims. The others were filed as individual arbitrations. All of these loan officers assert that BNC National Bank and BNCCORP, Inc. misclassified them as exempt from the overtime and minimum wage laws in violation of the federal Fair Labor Standards Act. 

Plaintiffs' attorney Michele R. Fisher stated, "The law has made clear over the past 10 years that loan officers should receive overtime pay. This company recently reclassified its loan officers as non-exempt and has started paying for overtime hours worked, but has not paid these employees the back wages they are due for prior hours worked. We seek to recover that pay through these arbitrations." Plaintiffs are represented by Michele R. Fisher and Reena I. Desai from Nichols Kaster, PLLP in Minneapolis, Minnesota.

The putative collective action arbitration is entitled: Richard Homburger et al. v. BNCCORP, Inc., and BNC National Bank.
