SANTA ANA, CA--(Marketwire - Jul 23, 2012) - According to Superior Court Case # PC052786 Gerald E. Duff Jr. vs. Ocwen Loan Servicing, MERS (Mortgage Electronic Registration), and Deutsche Bank National Trust were foreclosing on the Duffs on 04/09/2012. After several years of attempting to work directly with their Lender, paying over $24,000.00 hiring professionals and spending countless hours at three separate NACA conventions only to receive unsustainable short term rate reductions yet never addressing a loan balance that was more than twice what the home is valued at today.
Awaiting news from their lender the Duffs learned the notice of Trustee Sale was recorded at the County on 03/14/2012. The sale was scheduled to take place on 04/09. With their lender's final refusal to postpone the Trustee Sale the Duffs were directed to Consumer Protection Assistance Coalition (DE) Non Profit Law Clinic.
CPAC (DE) reaches out to Homeowners whom may have been misled, abused, unfairly treated or flat out defrauded by their Lender and may have either already been foreclosed upon or simply concerned about retaining their home. That about summed up what the Duffs were feeling so they were compelled speak to a CPAC Non Profit Attorney.
On 03/20/2012 the Duffs visited CPAC (DE), an experienced Foreclosure Defense Non Profit Law Clinic who patiently listened to their entire story and offered to provide a completely free Lender Fraud and Violation Analysis Report while they got Pre-Qualified for one of several programs that could result in a principal forgiveness. Mr. Guillermo Gutierrez, a Legal Case Evaluator for CPAC also explained the process of a Trustee Sale Reversal in the event the Duffs were reluctant to act swiftly and aggressively before the 04/09 Sale Date. Guillermo not only explained the process but he also showed the Duffs several actual cases where CPAC successfully reversed Trustee Sales for other Homeowners in more severe circumstances.
According to Foreclosure Defense Attorney Gary Lane, President of Consumer Protection Assistance Coalition (DE), "Fortunately for the Duffs, their decision to take immediate and aggressive action paid off, regardless of the natural skepticism often caused by the 'sounds too good to be true' feeling people too often have in this environment. Not only were we successful in finding acceptable violations to warrant a quality case be presented to the Courts but CPAC was also successful in having a Judge order a Temporary Restraining Order on the 04/09 Trustee Sale."
On 5/08/2012 CPAC Non Profit Foreclosure Defense Law Clinic received a settlement that took the Duffs' $1,016,000.00 loan balance which originally had a $4,779.18 payment and restructured the new balance by securing a principal reduction of $488,000.00. The new balance is now $528,000.00 with a 2% fixed interest rate and an affordable fixed payment of only $1,951.59.
