About the Lawsuit

Nuverra and certain of its executives are charged with issuing a series of materially false and misleading statements during the Class Period, violating federal securities laws.

These false statements and omissions included, in part, that: (i) Nuverra was suffering from a severe liquidity crisis; (ii) Nuverra was experiencing a significant decline in its operational results, especially in the Eagle Ford Shale area; and (iii) Nuverra's default risk was materially increased because of its poor financial performance and the Company faces potential defaults on its covenants.
