Ontario Health Agencies Applaud New Brunswick Government's Decision to Proceed With Cost Recovery Litigation Against Tobacco Industry

TORONTO, ONTARIO--(CCNMatthews - Dec. 21, 2006) - Major Ontario health agencies today applauded the New Brunswick government's decision to retain legal counsel in order to proceed with cost recovery litigation against the tobacco industry.

"New Brunswick is to be congratulated," said Michael Perley, Director of the Ontario Campaign for Action on Tobacco. "The province's leadership in retaining counsel to initiate legal action against the tobacco industry sends a strong signal to other provinces that the time is right to proceed, and the case is strong."

Perley went on to note that the Ontario government had recently decided not to pursue similar action, and said the health sector there will continue to encourage the government to change its stance. "Similar leadership from Ontario would be a great boost to the prospects for obtaining justice for the thousands of victims of tobacco industry products. The recovery of funds out of which all Canadian provinces and their citizens are alleged to have been defrauded by the industry's well-documented campaign of deception, is overdue," said Perley.

Perley pointed to the precedent set by the US$246 billion Master Settlement Agreement between all U.S. states and the tobacco industry as further evidence that litigation in Canada should succeed. He also referred to the Supreme Court of Canada's 2005 unanimous endorsement of legislation enabling the lawsuit, originally passed in British Columbia and now endorsed by five other provinces, as further support for legal action.

The Ontario Campaign for Action on Tobacco was founded in 1992 by the Canadian Cancer Society (Ontario Division), the Heart and Stroke Foundation of Ontario, the Non-Smokers' Rights Association, the Ontario Lung Association and the Ontario Medical Association to promote comprehensive tobacco control in Ontario.
