Ontario Provincial Police Officer Charged

Attention: News Editor TORONTO--(CCNMatthews - Sept. 12, 2005) - The Director of the Special Investigations Unit (SIU), James Cornish, has caused criminal charges to be laid against an Ontario Provincial Police (OPP) officer from the Napanee detachment.

On March 26, 2005, Constable Hagerman arrested James Hogle on Advance Avenue in Napanee. During the course of the arrest, Mr. Hogle suffered a broken collarbone. He was taken to Lennox and Addington County General Hospital and the OPP notified the SIU of the incident.

Based on the evidence from the SIU investigation, the Director concluded there are reasonable grounds to believe that Constable David Hagerman of the OPP committed the offence of assault causing bodily harm, contrary to Section 267(b) of the Criminal Code of Canada.

A summons has been issued requiring Cst Hagerman to appear at the Ontario Court of Justice in Napanee on October 4, 2005, to answer to the charges. Justice Prosecutions of the Ministry of the Attorney General will have carriage of the prosecution.

As this matter is now before the courts, the SIU will make no further comment pertaining to this investigation.

The SIU is a civilian agency that investigates circumstances involving police and civilians which have resulted in serious injury, sexual assault or death. Under Part VII, Section 113, of the Police Services Act, the Director of the SIU has the sole authority to decide whether or not charges are warranted based on the findings of a complete investigation. The Director's decision is reported to the Attorney General.
