SCHAUMBURG, IL--(Marketwired - Feb 18, 2014) - In a retrial with his client's career on the line, Martin LaScola, the newest attorney at Gardi & Haught, Ltd., successfully won his first case for the firm. His client was found "not guilty" on a driving while intoxicated (DUI) charge, after a 2013 trial of the same offense had resulted in a hung jury.
LaScola's client was a decorated public servant who was arrested on a DUI charge and tried after his arrest in 2012. When the jury could not reach a verdict, the client sought new counsel with Gardi & Haught. LaScola reviewed the original defense strategy, which used testimonials from witnesses in the company of the defendant on the night of the arrest.
"Rather than call upon the witnesses again, I relied on the lack of evidence the State was able to present," said LaScola. LaScola employed heavy cross-examination of the arresting officer and review of the video footage in the station following the arrest. The arresting officer claimed the defendant had trouble with his fine motor skills during the arrest, but the video at the station, taken 25 minutes later, showed the defendant able to tie and untie his laces when asked to remove his shoes for inspection of contraband. LaScola offered this evidence to contradict the State's assertion that the client's fine motor skills were diminished. Between LaScola's cross-examination and the video, the jury found his client "not guilty" after a two-hour deliberation.
"The defendant was in tears," said LaScola. "Had he been found guilty, he would have lost his job and that would have truly been the community's loss."
LaScola is a veteran prosecutor and defense attorney who has successfully defended hundreds of DUI cases. LaScola joined Gardi & Haught last month from private practice, and will be responsible for spearheading the handling of the firm's criminal misdemeanor and felony cases including DUIs, theft, battery, assault, rape and murder.
