Ryla Teleservices, Inc. Employees Represented by Nichols Kaster, PLLP File Action in Indiana to Recover Unpaid Overtime Wages

LAFAYETTE, IN--(Marketwire - Apr 15, 2011) - Ryla Teleservices, Inc. ("Ryla") call center employee Martha Swarthout ("Ms. Swarthout") filed an action in the United States District Court for the Northern District of Indiana, on behalf of herself and others similarly situated, to recover unpaid overtime wages under the Fair Labor Standards Act.

Ms. Swarthout claims in her complaint that Ryla required customer service representatives to perform uncompensated work before and after their shifts. That work included booting-up computers, initializing software programs, setting up "call backs," and reviewing work related emails. Ms. Swarthout's complaint also claims that Ryla used a time-tracking system that did not compensate customer service representatives for this pre and post shift work.

This case is entitled Swarthout v. Ryla Teleservices, Inc., Civ. No. 4:11-CV-21 (N.D. Ind.). It follows two other actions filed by other Ryla employees, also filed on behalf of themselves and others similarly situated, which complain of similar overtime violations in Ryla's Kennesaw, Georgia and Sarland, Alabama call centers. Many other customer service representatives have already joined those two cases. The other cases are entitled Slaughter-Cabbell et al. v. Ryla Teleservices, Inc., Civ. No. 1:11-CV-00202 (N.D. Ga.) and Robinson et al. v. Ryla Teleservices, Inc., Civ. No. 1:11-CV-00131 (S.D. Ala.).
