SmartMetric Awaits Final Court Ruling Following Today's District Court Hearing on Its Patent Infringement Case Brought Against Visa and MasterCard

President & CEO Chaya Hendrick said SmartMetric is awaiting the final ruling by the Judge hearing its patent infringement case that it has brought against both Visa and MasterCard in the United States Federal District Court in Los Angeles. U.S. District Judge Michael W. Fitzgerald provided a tentative ruling and gave opportunity for argument in response. The lawyer for SmartMetric Inc., Mr. Patrick Bright of Wagner, Anderson and Bright presented argument on legal facts. The company has no public comment to make in respect of the final decision and awaits the considered deliberation of Judge Michael W. Fitzgerald.

During the course of today's hearing Mr. Bright representing SmartMetric Inc. presented oral argument in response to a tentative court ruling presented to the Court by the Judge at the commencement of proceedings. The Company believes it is on solid legal ground in defending its Patent from infringement. The United States Patent and Trade Mark Office issued the Patent in question in 2004 after first being filed in 1999. The "464" Patent as it is referred to, is owned by SmartMetric Inc. SmartMetric Inc. is a card technology company with a fingerprint biometric activated card that uses a person's fingerprint to replace PIN numbers.
