SmartMetric Patent Infringement Lawsuit Against Visa & MasterCard Is About "EMV" Smart Cards

BAY HARBOR, FL--(Marketwired - Apr 30, 2013) - SmartMetric, Inc. (OTCQB: SMME) -- The President and CEO of SmartMetric, Inc., Ms. Chaya Hendrick, said this morning, SmartMetric's Patent infringement litigation against Visa and MasterCard is based on its issued "464" patent that covers data cards.

The Patent in question covers the use of data cards (smart cards) that are inserted into a reader that subsequently causes a connection to one of a multiple of networks. It has been wrongly thought that the Patent is only restricted to SmartMetric's biometric activated smart cards. This is not the case, Ms. Chaya Hendrick said today. The Patent in question is much broader and is not restricted to only Biometric Cards. It covers any kind of smart card including the banking industry's EMV Card used around the World that is in effect a "smart card."

SmartMetric has already had two markmen hearings in which the term data card has been clearly defined to cover "smart cards" therefore the question of whether the company's issued Patent covers banking "smart cards" is a settled point at law.

Ms. Chaya Hendrick said the company, SmartMetric, is looking forward to concluding its pre-trial processes by August of this year with the trial by Jury set for September 9^th, 2013. She said the company is in the process of deposing executives from Visa and MasterCard. Discovery has been completed and the matter is moving forward as scheduled by the Court.
