Spam Text Messaging Scandal: Insight from Spencers Solicitors

CHESTERFIELD, UNITED KINGDOM--(Marketwire - Oct. 5, 2012) - Personal injury solicitors use infographic to scratch beneath the surface of the most 'annoying' form of marketing in Britain - SMS spam.

An estimate of 20 million UK mobile users have been hit with spam text messages at some point, according to Spencers Solicitors. This is just one of many shocking statistics about spamming revealed by the law firm's astute infographic - created to expose the scandal and advise consumers what to do if they receive an unsolicited SMS.

A personal injury solicitor's viewpoint on the practice of 'smishing', a term coined to describe the combination of SMS spam and 'phishing', is of particular value - as lawyers are often generalised as the culprits behind the messages.

The infographic has been published just days after the Information Commissioner's Office (ICO) announced it is looking to penalise two individuals directly responsible for distributing 'millions' of spam texts.

Director of Spencers Solicitors, John Spencer, covered the topic in October 2011 via his legal blog:

"Unsolicited text messages promising £3,750 - for some reason, the amount is almost always £3,750 - are sent because of the cavalier disregard for personal data by those who stand to gain by treating personal injury claims as a commodity. Often enough, these text messages are sent to consumers regardless of whether they've actually been in an accident."

Now, 12 months on, the Derbyshire-based lawyer is still passionately advocating the fight against the misuse of personal data:

"It's great to see the ICO issuing six-figure fines to spammers because without that level of punishment, we'll continue to be pestered by nonsensical texts and the legal system will continue to be plagued with frivolous claims.

"The forgotten victims are those who genuinely have a case for compensation but are automatically marshalled into a fraudulent category, along with those who are pursuing frivolous claims which have been drummed up by spam marketing."

Meanwhile, the ICO have reported almost 30,000 complaints about SMS spam in the last six months. The infographic from Spencers suggests that figure is still dramatically small compared to the total amount received by OfCom, the Office of Fair Trading, the Ministry of Justice and multiple network providers, in confusion about where to send complaints.
