Supreme Court of Canada Decision in R. v. Khawaja


OTTAWA, ONTARIO--(Marketwire - Dec. 14, 2012) - The Supreme Court of Canada today released its decision in the case of Mohammad Momin Khawaja. The Court dismissed the defence appeal against conviction and sentence.

The Court ruled that the terrorism offences set out in sections 83.03, 83.18, 83.19 and 83.21 of the Criminal Code are constitutional. Therefore, the convictions entered on October 29, 2008 in the Superior Court of Ontario and the life sentence imposed on December 17, 2010 by the Ontario Court of Appeal are upheld.

The Public Prosecution Service of Canada is responsible for prosecuting offences under federal jurisdiction in a manner that is free of any improper influence and that respects the public interest. The PPSC is also responsible for providing prosecution-related advice to law enforcement agencies across Canada.
