TeleCommunication Systems Files Patent Infringement Lawsuit Against Sybase Inc. and iAnywhere Solutions Inc.

ANNAPOLIS, MD--(Marketwire - August 20, 2009) - TeleCommunication Systems, Inc. (TCS) (NASDAQ: TSYS), a leading provider of mission critical wireless communications, has filed a patent infringement lawsuit in the U.S. District Court for the District of Delaware against Sybase, Inc. (NYSE: SY) and iAnywhere Solutions, Inc., a wholly owned subsidiary of Sybase. TCS seeks an injunction against Sybase and iAnywhere from further infringement as well as monetary damages.

The lawsuit alleges infringement of United States Patent No. 6,560,604 by multiple Sybase and iAnywhere products, services and systems. The patent, entitled "System, Method, and Apparatus for Automatically and Dynamically Updating Options, Features, and/or Services Available to Client Device," was issued in 2003 and describes a technology that allows automatic over-the-air (OTA) initialization, configuration and updating of mobile devices, including cellular phones.

"The proprietary technology of automated over-the-air configuration of mobile devices was the result of pioneering development investment in wireless data solutions," said Mark Ramberg, TCS's director of intellectual asset management. "TCS depends on the patent system and laws to protect our investments in intellectual property on behalf of our stakeholders. With multiple and continued infringements of our intellectual property by Sybase and iAnywhere, we have no choice but to turn to the patent system and legal action to seek enforcement."

In a related action, TCS has filed a renewed petition requesting the suspension of the Sybase 365 initiated inter partes re-examination of U.S. patent No. 6,985,748, "Inter-carrier messaging service providing phone number only experience." TCS is requesting the re-examination be suspended pending the appeal of a district court final judgment affirming Sybase 365's infringement of the '748 patent. The renewed petition contains no new matter from the original petition filed in May 2009 as it provides the US Patent and Trademark Office with copies of documents referenced in the original petition.
