The Doctors Company: Potentially High-Exposure Malpractice Cases Can Be Won

Third Video in Series on Physician Case Studies Features ER Doctor Who Prevailed in OB Lawsuit

NAPA, CA--(Marketwired - September 05, 2013) - What a physician experiences when facing a malpractice claim involving a sympathetic case with potentially high exposure is detailed in a video released today by The Doctors Company, the nation's largest physician-owned medical malpractice insurer.

The video, the third in a series that showcases actual claims, features Malkeet Gupta, MD, MS, an emergency room physician with Antelope Valley Emergency Medical Associates, Inc., in Los Angeles, California. Dr. Gupta discusses the claim that was made against him after he treated a pregnant woman who complained of a lower urinary tract infection without any signs or symptoms of pre-term labor. The next day, the patient delivered a severely impaired baby and subsequently filed a lawsuit, in which Dr. Gupta ultimately prevailed. 

The video also features Dr. Gupta's claims specialist, Mark Savoie, regional assistant vice president, claims, The Doctors Company, who notes that this was a difficult case because there was a lot of sympathy involved for the baby and its mother. Dr. Gupta's attorney, James C. Schaeffer, JD, of Boyce Schaeffer, LLP, in Oxnard, California, adds that while this could have been a high-exposure case, The Doctors Company was willing to take the financial risk in defending its member who wanted to go to trial.
