Topics Entertainment Sues Rosetta Stone

RENTON, WA--(Marketwire - October 9, 2009) - Topics Entertainment today announced that, on October 6th, 2009, it sued Rosetta Stone to bring an end to Rosetta Stone's accusations concerning the packaging Topics uses for its products. The companies both sell software designed to teach foreign languages in bright yellow packages. Topics' "Instant Immersion" product, however, sells for a fraction of the price of Rosetta Stone's offering. Also, Topics has been using its packaging style since at least 1999, five years longer than Rosetta Stone says it's been using the packaging style that Rosetta Stone claims is causing a problem.

"We tried to explain that we were first," said Greg James, Topics' President. "And that the packaging elements Rosetta Stone was complaining about show up in the packaging of lots of other language learning software besides our own. We finally decided that we weren't getting anywhere and that's when we went to court to get some help."

Topics filed its case in the United States District Court for the Western District of Washington. Hours after Topics' filing, Rosetta Stone countered with a suit of it own in the Eastern District of Virginia.

Topics Entertainment is one of the nations largest privately owned publishers of CD ROM and DVD products. The company has been in business since 1990 and sells to all the major US retailers. Topics publishes or distributes for partners that include National Geographic, PBS, BBC, The National Archives, and many others.
