The lawsuit was assigned a case number of 87437A and it was filed because the infant plaintiff had suffered permanent and massive injuries and had allegedly suffered these injuries because of negligent conduct by the defendants. The lawsuit sought damages that would compensate the family of the infant plaintiff for the costs of care that would be required throughout the infant plaintiff's life.

According to the court documents, the lawsuit was filed because the infant plaintiff was born at the defendant hospital with multiple birth defects and medical problems. These birth defects included two club feet, a high arched pallet, low-set ears, excessive arches on her fingertips, a broad-bridged nose and micrognathia. The mother had been given a Pitocin drip to prompt labor, but that drip was discontinued and the child was delivered via C-section.

The court documents stated that the controversy arose because the defendants stopped monitoring the fetal heart rate when the Pitocin was discontinued and that this failure to continue to monitor the child for two hours before it was born led to damage that caused conditions such as severe mental retardation, motor deficits and an inability to feed herself. As a result, the two sides negotiated a settlement in the amount of $1,475,000.00 and the case is now considered closed.
